Ameristar Jet Charter, Inc. also brought a negligence suit against Dodson International Parts, Inc. for mishandling the Owner's airplane that was damaged after an emergency landing. The result of the case was based on the effect of this release, which was directly related to the claims against the insurer and was the subject of the court’s order and motion for summary judgment. Additionally, Ameristar Jet Charter asserted claims against its insurance carrier for negligent misrepresentation, negligence, and bad faith. The jury found in favor of Ameristar Jet Charter in the negligence case against Dodson International Parts, assigning 70% of the fault to Dodson and 30% to Ameristar.
The court ruled that the release barred further claims, analyzing the cause of the incident as determined in the case. Ameristar tried to bring additional claims, but the court considered the exposure to further liability. The court required Ameristar to produce evidence to determine damages and to reach a certain amount with reasonable certainty, including a showing of damages. The release signed by Ameristar Jet Charter discharged the insurance company from any further claims regarding the incident that damaged the Owner's airplane. The case between Ameristar Jet Charter and Dodson International was remanded for a new trial on the issue of damages or other relief.
The court’s decision was intended to prevent speculative damages and required a split of damages based on fault, with only the remainder of the damages recoverable. The record showed evidence of the bent fuselage and whether the damage occurred as a result of the incident or was otherwise caused. The aircraft was flying a charter mission at the time, and the case referenced operational and legal milestones in March, January, August, and December.
